{"id":1619,"date":"2019-09-30T17:04:45","date_gmt":"2019-10-01T00:04:45","guid":{"rendered":"https:\/\/www.enochslaw.com\/wp\/?p=1619"},"modified":"2024-10-13T19:39:13","modified_gmt":"2024-10-14T02:39:13","slug":"california-new-rent-control-law-ab1482","status":"publish","type":"post","link":"https:\/\/www.enochslaw.com\/wp\/blog\/california-new-rent-control-law-ab1482\/","title":{"rendered":"California\u2019s New Rent Control Law"},"content":{"rendered":"<p class=\"p1\"><span class=\"s1\">California legislators just passed a historic rent control bill, becoming one of a growing list of states to pass statewide rent control and other tenant protections.<span class=\"Apple-converted-space\">\u00a0 <\/span>The bill is expected to be signed into law by Governor Gavin Newsom, who supported its passage through the legislature.<span class=\"Apple-converted-space\">\u00a0 <\/span>Read on for details about the new law, and contact a knowledgeable <span class=\"s2\">San Diego real estate attorney <\/span>with any questions.<\/span><\/p>\n<h2>AB 1482: Rent Control For Older Buildings<\/h2>\n<p class=\"p1\"><span class=\"s1\"><a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=201920200AB1482\" target=\"_blank\" rel=\"noopener noreferrer\">Assembly Bill 1482<\/a><\/span><span class=\"s2\"> passed the California State Assembly by a 46-22 vote and is now on Gov. Newsom\u2019s desk.<span class=\"Apple-converted-space\">\u00a0 <\/span>Here\u2019s how the new law will work:<span class=\"Apple-converted-space\">\u00a0 <\/span>For any apartment building more than 15 years old (built before 2004), landlords are limited to a maximum five percent rent increase (after inflation) for existing tenants. <span class=\"Apple-converted-space\">\u00a0 \u00a0<\/span><\/span><\/p>\n<p class=\"p1\"><span class=\"s2\">Additionally, the bill limits the ability of landlords to evict tenants without a documented lease violation if the tenant has resided in the unit for more than a year.<span class=\"Apple-converted-space\">\u00a0 <\/span>If the landlord wants to convert the building to condos or otherwise make substantial renovations to units, they may evict tenants, but they must also pay relocation assistance equal to one month\u2019s rent.<\/span><\/p>\n<p class=\"p1\"><span class=\"s2\">The rent control does not apply to any buildings built in the last 15 years, or to single-family home rentals unless owned by corporations or other institutional investors.<span class=\"Apple-converted-space\">\u00a0 <\/span>The law does not replace or override existing rent-control laws that cities and municipalities have already passed, such as those in San Francisco, Oakland, and Santa Monica.<span class=\"Apple-converted-space\">\u00a0 <\/span>However, the bill does expand protections in those cities if their rent control laws are more limited;
